1. Merchant and acceptance

This website and store are operated by RITMO ENERGY LLC, doing business as DR. WELLS ("DR. WELLS," "we," "us," or "our"). Shopify provides the ecommerce platform used to offer our products and services. By accessing getdrwells.com or placing an order, you agree to these Terms of Service and the policies linked from the store. If you do not agree, do not use the site or purchase a product.

2. Eligibility and account information

You must be the age of majority in your place of residence and legally capable of entering a contract. You agree to provide accurate, current, and complete account, billing, payment, and shipping information and to protect your account credentials.

3. Products and health information

Our products are dietary supplements. Product descriptions, site content, and marketing materials are provided for general information and are not medical advice or a substitute for diagnosis or treatment by a qualified healthcare professional. No specific result is guaranteed. Review the product label, ingredients, directions, and warnings before use. Consult a qualified healthcare professional before using a supplement if you are pregnant or nursing, have a medical condition, take medication, are planning a medical procedure, or have questions about suitability. Stop use and seek appropriate care if you experience an adverse reaction.

Statements about dietary supplements have not been evaluated by the U.S. Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent any disease.

We make reasonable efforts to display products accurately, but colors and appearance may vary by screen and packaging may be updated. The label supplied with the product controls if it differs from a site image. We may limit quantities, correct errors, or discontinue products.

4. Orders, prices, and payment

Prices are shown in U.S. dollars unless stated otherwise. Taxes, shipping, discounts, and other applicable charges are shown at checkout. Placing an order is an offer to purchase. We may accept, reject, limit, or cancel an order for reasons including availability, suspected fraud, pricing or description errors, address problems, or legal restrictions. If we cancel after payment, we will refund the canceled amount to the original payment method.

Please review an order before submitting it. We may be unable to change or cancel an order after it has entered fulfillment. Refund and return requests are governed by our Return and Refund Policy.

5. Subscriptions

Subscription products renew automatically at the price and cadence disclosed before checkout until canceled. By purchasing a subscription, you authorize recurring charges to the payment method on file. Shipping charges and taxes may apply to each renewal. Cancellation and account-management details are set out in our Purchase Options Cancellation Policy. Canceling a subscription does not automatically cancel or refund an order already created, charged, or submitted to fulfillment.

6. Shipping and delivery

Eligible destinations, charges, tracking, address responsibilities, and delivery estimates are described in our Shipping Policy. Delivery dates are estimates, not guarantees. Delays may occur because of processing, carrier conditions, weather, holidays, address issues, or events outside our reasonable control.

7. Acceptable use

You may use the site only for lawful, personal, non-commercial purposes. You may not misuse the site, interfere with security or operation, introduce malicious code, scrape or harvest information without authorization, impersonate another person, infringe rights, submit false information, or use the site in violation of law.

8. Intellectual property

The site and its original text, graphics, product presentation, logos, photographs, video, software, and arrangement are owned by or licensed to DR. WELLS and protected by applicable intellectual-property laws. No right or license is granted except the limited right to use the site for its intended personal purpose.

We rely on third parties, including Shopify, payment providers, carriers, fulfillment providers, and software services. Third-party sites and services may have separate terms and privacy practices. Purchases from this store are transactions with DR. WELLS, not Shopify. To the extent permitted by law, Shopify is not responsible for products purchased from us.

10. Privacy and electronic communications

Personal information is handled as described in our Privacy Policy. By providing contact information, you agree to receive service communications relating to your account, orders, or subscriptions. Marketing communications are subject to the consent and unsubscribe choices presented to you.

11. Disclaimers

To the fullest extent permitted by law, the site and services are provided "as is" and "as available." We do not promise that the site will be uninterrupted, error-free, or suitable for every purpose. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

12. Limitation of liability

To the fullest extent permitted by law, RITMO ENERGY LLC and its officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the site or products. This limitation does not apply where liability cannot lawfully be limited, including any rights available under applicable consumer-protection law.

13. Governing law

These Terms are governed by the laws applicable in Wyoming, United States, without depriving consumers of mandatory rights available in their place of residence. Courts with lawful jurisdiction may hear disputes.

14. Changes and severability

We may update these Terms by posting a revised version with a new effective date. Material changes will be communicated when required by law. If a provision is found unenforceable, the remaining provisions continue in effect.
